I entered usa in H4 visa in july 2008 , while my H1 was applied from india in april 2008 ,and H1 got approved . now my employer is forcing me to do COS(H4 to H1) or go to india for stamping because he can't hold my H1 in a approved state so long . due to current market condition and so many rejections i am afraid to go for COS . He is asking $2800 only for regular COS processing !!!! thats too high , he is going to file fresh H1 petition I129 along with COS I539 .

my question is
instead of applying fresh H1 petition i.e I129 , since my H1 is already in approved state so can i apply only I539 for changing my status ?

Say am planning to stay abroad after filing 485 for more than 6 months and the consulting company is willing to support.
what can be the possible issues if stayed like an year or more if I am maintaining H1 status instead of using AP

USCIS has released figures from the first week of the H-1B season and filings for the 65,000 H-1B "regular" cap slots for the fiscal year that begins in October were just 13,500. That is less than one third of the 42,000+ received during the same period last year and only about one-tenth of the number filed two years ago. Only 5,600 masters cap applications were filed against the 20,000 cap in that category.

Hi,

I have applied my H1 extension in Sep 2008 and got RFE in Dec. RFE was about my work address and we have sent the details. On March 2 2009 I have received the email saying Denial Notice Sent. Not sure the reason yet. I wanted to check my options. I do have EAD. But not used. What is my visa status now? I am planning to resubmit my application based on the denial notice. If I resubmit will I have status in US? Or should I work on EAD. If I work on EAD what should i do? I mean do I need to file AC21?

My employer will file for H1 this April.
If my H1 is rejected for any reason, will I be eligible to work on F1 - OPT visa?

I received a RFE on 485 for a updated G-325 form and a Employment letter stating the Job details, Salary and if the Immigrant visa petition(labor certification) terms still exist. Iam a Jul,2007 filer, I have another 12 days to respond, this RFE was received by the company attorney. Now neither Employer/Company Attorney are responding to Phone calls/Emails regarding responding this to RFE. I do not understand what is their concern but came to know that few others from the same company got RFE on 485. Time is running out and if there is no response to the RFE, eventually the case will be denied. What are my options, Iam in my 4th year of my H1. I have a Valid EAD till Nov'2010 and H1 valid till Aug'2011. What will be my status if the 485 gets denied. Can I transfer the H1 to another employer and will need to start the GC process all over again ?
Any advice suggestions appreciated.

My brother is US Citizen and my parents visited US, my brother want to apply green card for my parents. What all the documents from India are needed from my parents to apply for GC?

1.What forms/applications do we have to apply?
2.What is the first step should we have to take?
3.Do we need to apply form I130 and along with that can we apply I485?
4.What all documents should my brother submit along with the forms/applications?

Hi,

Can someone tell me a little bit about visitor visa validity dates. For eg: if my parents got a 3 month visa, is it valid from the date it is issued or from the date of entry into the US?

It is valid from the date it is issued and they shld enter the US before it expires. However at the port of entry, the consular officer may chose it give it beyond the actual expiry date.

What is the difference been EB2 Vs EB2 NIW and when does one qualify for NIW

National Interest Waiver means that you do not have to have a job to petition for EB-2 GC. Consequently, there is no labor certification requirement. NIW petition is your petition; not some employers.

Guys, My labor was moved to Dallas Backlog center and got approved in 2006. When I searched its detail in files from flcdatacenter.com, I could not find any labor that matches my ETA number. I am not sure if there is any way to get the details. Though, online status site of Dallas backlog center shows the status but without any usable details. My labor's ETA number starts with D-xxxxx-xxxxx. Does any body has similar ETA number ?
