On a serious note, you just have to inform your (dependent's) employer and provide them a copy of your unexpired EAD. Thats it! The employer may require you to fill a new I9 form.

I believe someone already asked a similar question but I just want to describe my exact situation:
- My LC (EB3) got approved on July 2007, PD is March 2007 - Company A
- My I-140 and I-485 were filed concurrently on July 2007 - Company A
- I work as a contractor and my client (Company B) is offering me a full-time job and would like me to join on Sept 2007
- I still have 4 years on my H1B
With the assumption that my current employer (Company A) will give full cooperation on my current GC process, if I join company B on H1B transfer now, can I possibly invoke AC21 later after my I-140 gets approved and I-485 is pending for more than 180 days?
I'll greatly appreciate any comments.

Hi Gurus,
There was a minor RFE on my wife's I-485 (incomplete form I-1485 - a tick mark was missing) on 18 June. Our lawyer received the RFE and forwarded to us (I am not sure if we also are supposed to receive a copy of the RFE directly from USCIS but we did not). We replied to it and the lawyer sent it to USCIS this week such that it would have been received by USCIS on 1 Jul 09(Wed). I was expecting to see a status change to something like "Response to request for evidence received, and case processing has resumed". However, the case status changed to "Document mailed to applicant".
I am puzzled with this. Does anyone have a similar experience? Any guess what it might be?
Just getting anxious.

Hi,

My Masters OPT has expired in January 2009. Hence, I enrolled in a degree at a new school to get CPT work permit. My CPT work permit is expiring on 05/09/09.
As my H1-B petition is approved and the change of status has been applied, I came to know that my F-1 status is terminated, when I went to school to get updated I-20, with the new work permit.
What can I do at this moment, to get work permit.
Am I eligible for "Cap-Gap" relief?
Please let me know.

I have noticed that they have been given instructions not to give any information now due to the volume of calls HOWEVER if you keep trying you might get one person who is kind enough to answer your questions..
I tried 3 times (called with few days in between) and two time I faced pretty short replies with no help. But third time I got a very nice person who gave me more info. Among the few things I learnt were that they are still doing cases as of Aug 2006 and few random cases are being worked on dates after that. Details about I-140 will not be told unless you are the employer or the attorney. But you can ask about the status of your name check.

In above link, how is it possible to have pending I-485 (EB2) for 2008 & 2009 for India? If i remember correctly the priority date for India has reached upto Jul 2007 only so far.

For the past few months, there have been no green cards available for persons in the employment-based third preference category (EB-3) and long backlogs in the EB-2 category for persons born in India and China. So, with few green cards to grant, why has the USCIS been scheduling interviews for persons in these categories? The short answer is that just because the USCIS cannot grant most EB-3 and EB-2 applicants green cards, the agency can take advantage of the lull in applications for adjustment of status to deny persons with pending applications. A piece of good news on immigration was largely overshadowed by the Arizona mess. Republican Senator Richard Lugar of Indiana and Democrat Dick Durbin sent a letter to DHS Secretary Napolitano urging her to stop the deportations of students who might be eligible for relief if the DREAM Act or comprehensive immigration reform should pass. DREAM would allow some who entered the US as children to obtain permanent residency if they attend college or join the military. No word yet on how Napolitano reacted.

Last Friday was a depressing day for me. A businessman and his daughter visited me in my office. If your EAD is based on your husband's I-485 app I don't see any reason as to why that should affect your gc process if you move jobs.

I applied for I140 on January and receipt date is Jan 12 2007, I upgraded to PP during last days of June, and the receipt date for it was July 2nd and today i was checking the status, the status is showing a receipt date of July 5th, i called customer service center they say that receipt date is July 5th and this is not a premium case. I understand that they have temporarily suspended PP for 140, but even though my request for upgrade to PP was rejected, the receipt date should be still Jan 12 2007 or will they change it to latest date when request for PP upgrade was denied, anyone facing this issue?

EAD in hand from about 10 months.
If I move to a company with the exact same job description,
a) Whom do I need to inform, with regards to , AC21 portability clause
b) Who will check if the job is in the exact (same/similar) field
c)Possibility that there will be RFE after I-485?
d)What if the GC sponsoring company is not helpful after I move to a different company. How is this going to affect?
I need to weigh in the costs associated with countering a RFE and the increased salary due to job change.
Let me know your opinion.
